Terms of Service

These terms outline the expectations, policies, and conditions associated with working with Dylon North Photography.

Effective Date: April 6, 2026

I. Payment

Payment for services is due upon delivery of the order and before the order files can be downloaded. Clients will be invoiced, and payment can be made via the method agreed upon by both parties. If the client has a prior agreement with the photographer for net terms, those terms will supersede this clause.

II. Late Payment Fees

If payment is not received by the due date specified in the invoice, or within 15 days if no date is specified, a late fee of 30% will be applied to the outstanding balance for each month overdue. If payment is overdue by more than 2 months, the photographer reserves the right to pursue legal action to recover the amount owed, and the client will be responsible for any associated legal fees.

III. Accurate Information

The client is responsible for providing accurate and complete information about the property, including square footage, number of rooms and bathrooms, and property type. The client must also communicate any specific requests, angles, or features to be captured prior to or at the time of the shoot. Additional requests beyond the agreed scope may result in additional charges.

IV. Property Readiness & Access

The client is responsible for ensuring the property is clean, staged, and ready for photography at the scheduled time. This includes, but is not limited to, cleaning, decluttering, making beds, and removing personal items.

The client must ensure the photographer has proper access to the property, including keys, lockbox codes, alarm codes, or on-site contact if required.

If the property is not ready, inaccessible, or significantly differs from the provided information at the time of arrival, the photographer reserves the right to proceed with the shoot as-is, reschedule the appointment with additional fees, or charge a cancellation or trip fee.

If other photographers or contractors are present on-site during the scheduled shoot without prior agreement, the photographer reserves the right to classify the appointment as a cancellation and charge 100% of the order amount.

V. Extra Fees

Additional fees may apply for services beyond the agreed scope, including but not limited to additional photos, advanced editing, virtual staging, virtual twilight, item removal, or other post-production services.

Licensing beyond standard real estate listing use may incur additional fees based on the intended use of the media.

VI. Delivery

Photographs will typically be delivered within 24 hours of the shoot as MLS-sized JPEGs and full-resolution JPEGs via an online gallery or backend system, including a property website where applicable.

Video content will typically be delivered within 24–72 hours.

Third-party services such as 3D tours, floorplans, or virtual staging are outsourced and may vary in delivery time. These services are outside of the photographer’s control and will be delivered as soon as they are received.

Delivery timelines are estimates and may vary due to workload, technical issues, or third-party services. Every effort will be made to meet stated timelines.

VII. Revisions

Revisions may be requested within 48 hours of delivery free of charge for reasonable edits. Additional revisions or requests beyond this period may incur an editing fee of $1.50 per photo or as otherwise determined.

Requests that require a return visit to the property will be subject to a re-shoot fee plus applicable travel costs, unless the issue is directly the responsibility of the photographer.

VIII. Creative Control

The photographer retains full creative control over the execution, composition, and final delivery of all media. While client requests and preferences will be considered, final artistic direction remains at the discretion of the photographer.

IX. File Storage

Delivered media is stored for a limited time and is not guaranteed to be archived indefinitely. Clients are responsible for downloading and securely storing all delivered files upon receipt. Dylon North Photography is not liable for lost or inaccessible files after delivery.

X. Rights & Licensing

All media produced by Dylon North Photography remains the sole property of the photographer, including all copyrights and ownership rights.

Clients are granted a limited license to use the media for marketing and promotion of the specific property listing. Use of media for personal branding, future listings, builder marketing, commercial use, or any purpose beyond the original listing requires additional licensing and approval.

Media may not be transferred, shared, or distributed to third parties, including other agents, brokerages, builders, or homeowners, without written permission and appropriate licensing.

It is prohibited to re-edit, manipulate, or alter the media without prior written consent from the photographer.

XI. Property Release

The client grants the photographer the right to use all produced media for portfolio, marketing, and promotional purposes. This may include use on websites, social media, and other marketing materials.

XII. Rescheduling & Cancellations

Clients must provide a minimum of 16 hours notice for rescheduling or cancellations.

Cancellations or rescheduling within 16 hours of the scheduled shoot will incur a $50 fee. Cancellations or rescheduling within 2 hours of the scheduled time will incur a fee equal to 100% of the order amount.

XIII. Weather Policy

Photography will proceed in most weather conditions except for severe conditions such as heavy rain or hail. If exterior photography cannot be completed due to weather, the client may reschedule exterior shots at no additional charge.

Cloudy conditions or lack of sunlight do not qualify for rescheduling under this policy.

XIV. Drone Policy

Drone services are subject to weather conditions, airspace restrictions, and Transport Canada regulations. If drone operation is not permitted or safe at the time of the shoot, alternative solutions may be offered. Adjustments or refunds for drone services are at the photographer’s discretion.

XV. Photo Guarantee

The photographer will make every effort to ensure high-quality images that represent the property accurately. If concerns arise, reasonable re-editing will be provided at no additional cost.

If a return visit is required due to property condition, additional requests, or factors outside of the photographer’s control, a minimum re-shoot fee of $80 plus travel fees will apply.

No refunds will be issued based on dissatisfaction with style, as the client is expected to review the photographer’s portfolio prior to booking.

XVI. Video Guarantee

The videographer will make every effort to ensure high-quality video delivery. Music used will be copyright-free unless otherwise specified.

If a client requests a music change after delivery, a $50 re-editing fee will apply.

If additional filming is required due to factors outside of the videographer’s control, a minimum re-shoot fee of $125 plus travel fees will apply.

No refunds will be issued based on dissatisfaction with style.

XVII. Refund Policy

Due to the nature of digital media services, all sales are final and non-refundable once services have been rendered.

XVIII. Limitation of Liability

Dylon North Photography shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of listing opportunities, marketing performance, or business outcomes resulting from the use or inability to use delivered media.

XIX. Force Majeure

The photographer shall not be held liable for failure to perform due to circumstances beyond reasonable control, including but not limited to illness, equipment failure, weather conditions, or unforeseen events.

XX. Governing Law

These terms shall be governed by and interpreted in accordance with the laws of Ontario, Canada. Any disputes arising from these terms shall be resolved within that jurisdiction.
